Conduct: On 15 May 2020 Martin James Smith (“Mr Smith”) applied and obtained a Government backed Bounce Back Loan (“BBL”) of £50,000 for Dead Vibey Leisure Limited to which it was not entitled by providing false and / or inaccurate information regarding Dead Vibey Leisure Limited’s turnover in that: • A business was eligible for a BBL if it was engaged in trading or commercial activity in the UK at the date of the application, was carrying on business on 1 March 2020 and had been adversely affected by coronavirus (COVID-19). • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 or estimated annual turnover if it had been established after 1 January 2019. • Dead Vibey Leisure Limited was incorporated on 05 September 2018. • Annual Accounts filed at Companies House on 18 June 2020 show the company’s turnover for the period ending 30 September 2019 to have amounted to £52,093. • The first transaction recorded in the Dead Vibey Leisure Limited’ s bank account statements was on 17 September 2018. • The total income into Dead Vibey Leisure Limited’s bank account during 2019 amounted to £119,487.15. These payments included sums of at least £74,000 from Mr Smith’s co-director and a further business operated by this co-director, which appear to represent funding provided to Dead Vibey Leisure Limited rather than company turnover. • On 15 May 2020 Mr Smith applied for a BBL of £50,000, stating that Dead Vibey Leisure Limited’s turnover was £220,000. • Based on this Dead Vibey Leisure Limited was not eligible for a BBL in the sum of £50,000.
