Conduct: On 7 May 2020, Amir Mohammad (“Mr Mohammad”) caused S&A Food Store Ltd (“S&A”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, as a result S&A received more funds than it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it is their estimated turnover. • S&A was incorporated on 4 September 2018. • On 7 May 2020, Mr Mohammad applied for a BBL of £50,00 on behalf of S&A declaring that its turnover for the calendar year 2019, or estimated annual turnover was £200,000. • Accounts for S&A for the period ending 31 August 2019, signed on 28 February 2020 by Mr Mohammad record turnover for the trading period to be £76,404. • S&A’s bank account records turnover for the period 01 September 2019 to 31 December 2019 to be £24,955. • Based on the amount of turnover shown in the accounts to 31 August 2019 and the turnover in the bank statements from 01 September 2019 to 31 December 2019, the maximum turnover for the 2019 calendar year was £101,359, and the maximum amount of BBL funds that could be obtained was £25,340. • On 21 May 2020 S&A received the BBL funds of £50,000 into its bank account. • S&A made no repayments towards the BBL. • S&A entered into Creditors Voluntary liquidation on 8 December 2022. Total liabilities at liquidation amounted to £50,000 which was the amount owed in respect of the BBL.
