Conduct: On 22 May 2020, Mr. Vitalijus Ezerskis (“Mr. Ezerskis), caused Wito Limited (“Wito”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, when he knew or ought to have known that the turnover claimed on the BBL application was incorrect. As a result, Wito received more funds than it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019; or where a business was established after 01 January 2019, applicants were to provide their estimated annual turnover from the date the business commenced to trade. • Wito was incorporated on 28 August 2018 and commenced to trade prior to 01 January 2019. It was therefore not entitled to provide an estimate of annual turnover. • On 22 May 2020, Mr. Ezerskis applied for a BBL of £50,000 on behalf of Wito. The application asked Mr. Ezerskis to declare turnover for the calendar year 2019. Mr. Ezerskis declared turnover for Wito was £200,000. Wito received the BBL funds of £50,000 on 26 May 2020. • Wito filed accounts at Companies House for the period ending 31 August 2019 and 31 August 2020 which showed turnover of £27,028 and £28,913 respectively. • Wito’s bank statements show total sales related credits of £35,015 for the 2019 calendar year. Based on this amount, Wito would have been entitled to apply for a BBL of £8,754. Therefore, Wito has received BBL funds of £41,246 to which it was not entitled. On 29 February 2024, Wito entered Creditor’s Voluntary Liquidation with total liabilities listed of £48,502; £45,500 of which was listed as being owed in respect of the BBL.
