Conduct: Mr Gary Frederick Hibberd (“Mr Hibberd”) failed to ensure that Best Social Enterprise Ltd (‘Best Social’), made payments in full, as and when due, to Her Majesty’s Revenue and Customs (‘HMRC’) in respect of VAT and PAYE/NIC, and caused Best Social to trade to the detriment of HMRC from 07 October 2019 to 07 July 2022 resulting in total liabilities owed to HMRC, the majority creditor at liquidation, of £357,105 inclusive of charges and interest. In that: • Between the periods ending August 2019 and May 2022 Best Social incurred VAT liabilities of £88,476 based on returns submitted to and assessments raised by HMRC, inclusive of surcharges and penalties. Best Social have made no payments towards these liabilities. • HMRC have submitted claims for outstanding PAYE and NIC liabilities owed by Best Social totalling £268,629, based on returns submitted to HMRC for tax years ending April 2020, 2021 and 2022, inclusive of penalties. During this period, Best Social made payments totalling £912 towards its PAYE liabilities, being £302 towards tax year ending April 2020 and £610 towards tax year ending 2022. • Best Social’s prepared financial statements for years ending 31 August 2020 record total liabilities of £54,249, including liabilities owed to HMRC total £46,749. • Statements for Best Social’s bank account for the period 07 October 2019 to 07 July 2022 record payments into the account totalling £4,124,654 and debits from the account totalling £4,161,056. In the same period, HMRC received payments totalling £912 for PAYE/NIC. • HMRC have claimed £406,359, inclusive of interest and penalties in Best Social’s liquidation. This includes Corporation Tax and assessments and charges raised after the company ceased to trade, which have not formed part of this allegation. Best Social’s other creditors at liquidation are Bank £38,000 and Landlord £80,000.
