Conduct: Barnaby John Cook (“Mr Cook”) caused Eversmart Home Services Ltd (“Eversmart”) to breach the conditions of the Bounce Back Loan facility ("BBL") by applying for two further BBLs totalling £100,000 on 13 May 2020 that Eversmart was not entitled to, having previously obtained a BBL of £50,000 on 05 May 2020, in that: •The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover in calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. A Company was entitled to apply for one BBL. •On 05 May 2020, Mr Cook made an application for a BBL of £50,000 on behalf of Eversmart. The BBL funds were paid into Eversmart’s bank account on 11 May 2020.    •On 13 May 2020, Mr Cook made two further applications with two different financial institutions for BBLs of £50,000 each on behalf of Eversmart. The BBL funds were paid into Eversmart’s bank account on 13 May 2020 and 14 May 2020.    •Eversmart was not eligible for the second and third BBLs as a criterion of the loan is that a company can only have one BBL. Eversmart had also received the maximum value of loan it was entitled to when the company applied for the first BBL. •Mr Cook signed the declarations on the second and third BBL applications on 13 May 2020 confirming that Eversmart had not received any other BBL.  •Eversmart made payments totalling £3,732 in repayment of the second BBL and payments totalling £6,137 in respect of the third BBL. •On 20 November 2024 a payment of £40,000 was made to the financial institution that provided the second BBL. As the payment was made post liquidation, the funds were remitted to the liquidator. •Eversmart entered Compulsory Liquidation on 24 April 2024. •At liquidation, Eversmart had liabilities totalling £572,141 of which £43,137 is owed in respect of the first BBL and £90,759 is owed in respect of the second and third BBLs.
