Conduct: On 25 June 2020, Ma-E-Da Begum (“Ms Begum”) caused Maeda & Co Ltd (“Maeda”) to obtain a Bounce Back Loan (“BBL”) of £50,000, which she knew or ought to have known that the company was not entitled in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant, and the turnover required was that of the calendar year 2019 or where a business was established after 01 January 2019 it is their estimated turnover, provided it was carrying on business on 01 March 2020 and engaged in trading or commercial activity at the date of the application. • Maeda was incorporated on 20 June 2018. It filed dormant accounts at Companies House on 22 July 2019 covering the period to 30 June 2019. • On 25 June 2020 Ms Begum applied for a BBL of £50,000 on behalf of Maeda, declaring that its estimated turnover was £230,000. • Bank statements show the BBL funds of £50,000 were received into Maeda’s bank account on the 25 June 2020. Prior to receipt of the BBL funds, the credit balance on Maeda’s bank account was nil. • Other than the receipt and dispersal of the BBL, the bank statements show no income until 08 July 2021. • Ms Begum states that Maeda commenced trading on 25 July 2020, as confirmed in the Report to Creditors. As it was not carrying on business on 01 March 2020, nor engaged in trading or commercial activity at 25 June 2020, Maeda was not eligible to apply for a BBL of any amount and therefore received £50,000 to which it was not entitled. • Maeda entered Liquidation on the 17 September 2024 with overall liabilities of £53,150 including £51,457 owed to the BBL provider.
