Conduct: On 30 June 2020, Grzegorz Bernat (“Mr Bernat”) caused Gregmax Ltd (“Gregmax”) to apply for a government-backed Bounce Back Loan (“BBL”) of £50,000 using overstated turnover figures, when he knew, or ought to have known, that Gregmax was only eligible for a loan to a maximum amount of £13,198 and, in addition, Mr Bernat failed to ensure that the BBL funds were used for the economic benefit of Gregmax, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover for the calendar year 2019. The turnover figure was self-certified by the applicant and the BBL funds could only be used to provide an economic benefit to the business and not be used for personal benefit. • Gregmax was incorporated on 11 June 2018 and began trading on the same date. • Grzegorz Bernat was appointed as sole director on 11 June 2018 and remained so until the company’s liquidation. • On 30 June 2020, Mr Bernat applied for a BBL of £50,000 on behalf of Gregmax, stating in the loan application that Gregmax’s relevant turnover was £200,000 • An analysis of Gregmax’s bank statements from 1 January 2019 to 31 December 2019 show turnover total relevant credits as £52,788.08, therefore the maximum BBL that could be obtained was £13,198. • Gregmax therefore received BBL funds of at least £36,802 more that it was entitled to. • On 30 June 2020, a BBL of £50,000 was paid into Gregmax’s bank account. At the time the BBL funds were received, the account was overdrawn by £4,325. • Between 6 July 2020 and 12 July 2021, at least £50,000 was withdrawn from the account. those withdrawals included BBL funds. • Mr Bernat has failed to provide evidence to demonstrate that the withdrawn BBL funds were applied for the economic benefit of Gregmax • At the date of the liquidation on 10 January 2025, the Statement of Affairs shows that total liabilities amounted to £53,397, of which £46,161 was in respect of the BBL.
