Conduct: Mr Emmanuel Chinedu Ofougwuka (“Mr Ofougwuka”) caused EMC Express Ltd (“EMC”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by applying for two BBLs when he knew or ought to have known EMC was not entitled to the second BBL. In that: • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making the application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. It was also a requirement of the scheme that the applicant confirm that no other BBL application had been made for the same business. • EMC was incorporated on 31 May 2018, commencing trading in May 2018 and therefore required to provide turnover for the calendar year 2019 when applying for a BBL. • Financial statements for the year ended 31 May 2019 show a turnover of £21,758 and for the year ended 31 May 2020 show a turnover of £93,371. • Analysis of EMC’s bank statements show that EMC received credits in the account for the calendar year 2019 of £59,975.95. • On 7 May 2020, Mr Ofougwuka applied for a BBL of £10,000 (“BBL1”) on behalf of EMC from Bank A. On the BBL application, Mr Ofougwuka stated that EMC’s turnover was £60,000. The BBL was credited to EMC’s bank account on 07 May 2020. • On 28 July 2020, Mr Ofougwuka entered into an agreement for a second BBL (“BBL2”) of £40,000 with Bank B. In the BBL2 application process, Mr Ofougwuka declared that EMC (or any part of a wider group) was not already in the process of applying for or had received a BBL. • On 30 July 2020, EMC received a second BBL of £40,000. The balance on the account with Bank B prior to receipt of the second BBL was £49. • EMA was only eligible to apply for one BBL. Based on EMC’s financial accounts, EMC was eligible for one BBL of approximately £14,993. EMC received a second BBL of £40,000 which it was not entitled to. • Total liabilities at Liquidation amount to £73,605, of which at least £7,061 and £31,148 relates to the amount owed in respect of the two BBL’s.
