Conduct: Mr Daniel Evans (“Mr Evans”) caused D Evans Refurbishment Ltd (“DER”) to act in contravention of the Bounce Back Loan (“BBL”) scheme by failing to use the £30,000 BBL obtained for the economic benefit of DER. In that: A Company was entitled to apply for one BBL of up to 25% of its 2019 turnover up to a maximum of £50,000 under the BBL scheme. DER was incorporated and commenced to trade on 26 May 2018. On 27 July 2020 Mr Evans applied for a BBL of £30,000 from a bank. On the BBL application form, Mr Evans agreed “The Borrower shall use the Loan for the Authorised Purpose only” with the Authorised Purpose being “the purpose of working capital or investment to provide an economic benefit to the business of the Borrower […]”. The BBL funds were deposited in the DER’s bank account on 30 July 2020. Before receipt of the BBL, the account was £15.17 in credit. After receipt of the BBL, the only payment into the account other than interest rebates was one refund for a purchase of £25. Between 30 July 2020 and 26 October 2020, Mr Evans transferred £30,063 to himself, and took out £50 in cash from DER’s account. Mr Evans has stated that this money was used to purchase tools for DER and that these tools were later stolen. No evidence has been provided to verify the purchase of the tools or the subsequent theft. The Bank is a creditor in the liquidation and has claimed £30,193.42 for the outstanding BBL.
