Conduct: Lavinia Larisa Mociar (“Mrs Mociar”) made false representations about turnover in an application for a Government Bounce Back Loan (“BBL”) of £50,000 and caused L&M Construct Ltd (“L&M”) to apply for the BBL at a time when L&M had ceased to trade, contrary to the terms of the BBL scheme, and following receipt of those BBL funds, between 9 October 2020 and 14 December 2020, made payments that were not for the economic benefit of L&M. In that: - • L&M ceased to trade on 9 October 2019. • Prior to receipt of the BBL, L&M’s bank account balance stood at £47.83. • Between 9 October 2020 and 4 December 2020 other than the BBL, credits to the account were £3,330 received under the HMRC’s Job Retention Scheme. • Between 9 October 2020 and 14 December 2020 payments out of the account totalled £53,375. • Creditors at the date of liquidation on 17 November 2021 are £50,146.17 comprising the £50,000 BBL, £46.17 overdraft and £401.56 to HMRC.
