Conduct: Jayson Bartlett (“Mr Bartlett”) caused BBR Construction Ltd (BBR) to trade to the detriment of HM Revenue & Customs (“HMRC”) from 07 October 2019 for VAT, through to liquidation on 29 September 2022 resulting in total liabilities of £89,755; and for Corporation Tax (CT) from 01 March 2020 to liquidation resulting in total liabilities of £76,543 plus penalties of £2,482, in that:- VAT BBR registered for VAT from 04 May 2018. BBR submitted a return for quarter period ending 31 August 2019 on 05 October 2019 for £13,574 due for payment in full by 07 October 2019. 4 payments totalling £9,477 were made and allocated to this return by HMRC, however this was not sufficient to pay the amount for this quarter reducing the amount owed to £4,097. BBR submitted 10 further VAT returns for quarter periods ending 30 November 2019 through to 28 February 2022 totalling £85,678. No payments have been made to this liability. On 17 March 2022 a time to pay arrangement was made, however this failed on 06 June 2022. VAT of £89,725 remains outstanding at liquidation. . Corporation Tax BBR submitted a CT return for the accounting period ending 02 May 2019 in the sum of £12,438 and for the accounting period ending 31 May 2019 in the sum of £14,707, due for payment on 01 March 2020. BBR submitted a CT return for the accounting period ending 31 May 2020 in the sum of £21,823, due for payment on 01 March 2021. BBR submitted a CT return for the accounting period ending 31 May 2021 in the sum of £27,575, due for payment on 01 March 2022. Penalties of £2482 have been charged and remains outstanding in liquidation. No payments have been made in respect of CT and £76,544 remains outstanding at liquidation Comparable treatment of other creditors Accounts for year ended 31 May 2019 show HMRC were owed £79,812 and other creditors were owed £5,265. At liquidation, HMRC are owed £239,492 and other creditors are owed £56,500 of which £50,000 relates to a bounce back loan. The accounts for year ended 31 May 2019 showed Mr Bartlett had an overdrawn loan account totalling £42,212 outstanding. At liquidation this had increased to £247,469. Analysis of company bank statements for the period 07 November 2019 to 21 September 2022 shows income received of £962,945 and payments out totalling £1,196,760 of which £8,176 was paid to HMRC.
