Conduct: Mr Vasile-Adrian Popa (“Mr Popa”) caused Vasyad Services Ltd (“Vasyad”) to apply for a Bounce Back Loan (“BBL”) of £50,000, received by Vasyad on 22 May 2020, when Mr Popa knew or ought to have known that the company turnover he included in the BBL application was overstated. As a result, Vasyad received more than it was entitled to from the BBL scheme. Furthermore, BBL funds obtained were not used for the economic benefit of Vasyad, as was required by the terms of the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started. • Vasyad was incorporated on 23 April 2018 and started to trade on the same date as per the report to Creditors. Vasyad’s accounts for the periods ended 30 April 2019 and 30 April 2020 disclose turnovers of £25,829 and £21,084 respectively. • Vasyad received a BBL of £50,000 on 22 May 2020, the BBL application submitted by Mr Popa having declared that the company’s annual turnover was £230,000; • By overstating the turnover in the BBL application, Mr Popa caused Vasyad to receive approximately £43,543 more funds than it was entitled to. • On the same day the £50,000 BBL was received (22 May 2020), £40,000 of these BBL funds were transferred out of the Vasyad’s account for Mr Popa’s personal purposes rather than for Vasyad’s economic benefit as required by the BBL scheme. • Total liabilities at liquidation were £49,124, including £44,324 owed to the bank in respect of the BBL obtained.
