Conduct: Kestutis Puleikis (“Mr Puleikis”) caused Kestutis Cargo Limited (“Kestutis”) to breach the terms & conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover when he knew or ought to have known that Kestutis was not entitled to a BBL of £50,000 based on its turnover, resulting in Kestutis receiving more monies than it was entitled to. In addition, at least £31,000 was not used for the benefit of the company. In that :- • The Bounce Back Loan criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover for the 2019 calendar year. • Kestutis was incorporated on 17 April 2018. • In the BBL application form the stated turnover for the 2019 calendar year was £220,000. • The BBL of £50,000 was paid into the company bank account on 17 May 2020. • Accounts for years ending 30/4/19 and 30/4/20 show turnover of £33,035 and £23,536 respectively. • A review of the company bank account between 01 January 2019 and 31 December 2019 shows income/turnover paid in totalling £25,887. • Based on the above income paid into the company bank account Kestutis would have been eligible for a BBL of £6,472. • A review of the company bank account shows, following the receipt of the BBL of £50,000 on 17 May 2020, payments totalling £31,000 were made to Mr Puleikis between 18 May 2020 and 01 June 2020, these payments have not been explained by Mr Puleikis and do not appear to have been for the benefit of the company. • As at the date of liquidation Kestutis had liabilities totalling £51,335 of which £46,425 was in respect of the BBL.
