Conduct: On 05 June 2020, Steven Butler caused SMB Construction Limited (“SMB”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application, as a result SMB received more funds than it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019.   • SMB was incorporated on 05 April 2018 and accounts show the company was trading at 01 October 2018. • On 13 October 2020, Mr Butler applied for a BBL of £50,000 on behalf of SMB declaring that its turnover for the 2019 calendar year was £200,000. • SMB received the BBL funds of £50,000 on 15 October 2020. • SMB’s bank statements show a turnover of £29,931.09 for the period 01 January 2019 to 31 December 2019. • According to the turnover shown on the bank statements SMB would have been entitled to apply for a maximum BBL of no more than £7,482.78. • SMB therefore received BBL funds of at least £42,517.22 to which it was not entitled. • On 21 May 2024, SMB entered Creditor’s Voluntary Liquidation with declared assets of £13,750.00, total liabilities of £50,924.54, of which £50,414.32 was owed in respect of the BBL.
