Conduct: On 23 July 2020 Kuen Yiu To (“Mr To”), also known as Kieren To, obtained a £50,000 Bounce Back Loan (“BBL”) for Emma Claire Bridal Limited (“Bridal”), which was more than it was eligible for, by providing misleading information about its relevant turnover, in that: • Under the BBL scheme a business that was established before 01 January 2019 could apply for a loan of 25% of its turnover in the 2019 calendar year, up to a maximum of £50,000; • Bridal was incorporated on 28 February 2018; • On 23 July 2020 Mr To applied for a £50,000 BBL for Bridal, declaring a turnover of £220,000 and the loan was received in the company’s bank account on 24 July 2020; • Bridal’s accounts for the year to 28 February 2020 show turnover of £49,474; • Bridal’s bank statements show receipts in January and February 2019 of £5,706; • Bridal’s 2019 calendar year turnover was therefore unlikely to have exceeded £55,180, on the basis of which the company was eligible for a BBL of no more than £13,795; • Bridal went into liquidation on 18 April 2023, at which time £41,700 was still owed to the BBL lender.
