Conduct: Giulia Muscara (“Miss Muscara”) caused You Are Beauty Limited (“YAB”) to overstate its turnover in an application made on 10 September 2020 for a Bounce Back Loan (“BBL”) of £50,000, and as a result obtained £36,390 more than YAB was entitled to. In that: • Under the BBL scheme, businesses were entitled to apply for a loan of between £2,000 and £50,000, up to a maximum of 25% of turnover in the calendar year 2019. • YAB was incorporated on 27 February 2018. • Analysis of YAB’s bank account shows that between 01 January 2019 and 31 December 2019, YAB’s turnover totalled £54,440, which would have entitled YAB to obtain a BBL of £13,610. • On 10 September 2020, Miss Muscara submitted a BBL application in which she stated that YAB’s turnover in the calendar year 2019 was £250,000, and on 11 September 2020, the BBL funds £50,000 were deposited into YAB’s bank account. • By overstating YAB’s turnover in the BBL application, YAB received £36,390 (£50,000-£13,610) more than it was entitled to. At the date of liquidation, the overall estimated deficiency was recorded as £57,089 of which at least £50,094 was over to the BBL lender in respect of the BBL.
