Conduct: On 04 November 2020, Declan Kitching (“Mr Kitching”) allowed Associate-App Ltd to breach the terms and conditions of the Government-backed Bounce Back Loan ("BBL") scheme by overstating its estimated turnover on the BBL application, as a result, Associate-App Ltd has received BBL funds of £50,000 that it was not entitled to.     • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated turnover for the 12 months after the business started.     • Associate-App Ltd was incorporated on 21 February 2018, and was set up to develop an app. A bank account was opened on 09 March 2018. Accounts for the financial year ending 28 February 2019 declare that Associate-App Ltd was dormant. On 06 January 2020, payments commenced to an app developer. As such, any estimate of turnover in relation to the BBL was required to be for the 12-month period starting 06 January 2020 at the latest.   • On 04 November 2020, an application for a BBL of £50,000 was made on behalf of Associate-App Ltd. The application asked for turnover to be declared for the calendar year 2019, or if the business was established after 01 January 2009, to estimate annual turnover from the date the business was started. The BBL application submitted on behalf of Associate-App Ltd declared turnover was £215,000.     • By the time the BBL was applied for on 04 November 2020, nearly 10 months after commencing payments to the developer, and nearly 21 months after being incorporated, Associate-App Ltd had made no sales. As such, there was no reasonable expectation that Associate-App Ltd would achieve sales of £215,000 by 06 January 2021.    • Associate-App Ltd received the BBL funds of £50,000 on 06 November 2020.   • Associate-App made repayments of £16,219 • Associate-App entered Creditors’ Voluntary Liquidation on 1 February 2024 • Total liabilities at liquidation amount to £41,400 of which £36,400 relates to the amount owed in respect of the BBL.
