Conduct: On 26 May 2020 Viroel-Cristian Nita caused Forza Contracts Ltd (“Forza”) to make a Bounce Back Loan (“BBL”) application of £50,000 using an overstated turnover figure when he knew or ought to have known that Forza was not entitled to a loan of that amount. As a result, Forza received more BBL funds than it was entitled to, in that: • The terms of the BBL Scheme stated that a business could apply for a loan of up to 25% of the Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it was their estimated annual turnover from the date the business started. • Forza was incorporated on 30 January 2018. • On 26 May 2020 Mr Nita applied for a BBL of £50,000 on behalf of Forza stating a turnover figure of £200,000. • Forza filed dormant accounts with Companies House for the year to 31 January 2019. According to its bank statements no trading activity took place until February 2019. • According to unaudited financial statements of Forza, turnover in the year ended 31 January 2020 had been £20,681. • According to bank statements, Forza received no trade credits until February 2019. Between 20 February 2019 and 26 May 2020 trade credits totalled £39,500, which would have entitled Forza to a maximum BBL of £9,875. • Forza received the BBL funds on 06 June 2020. • Forza was placed into creditors’ voluntary liquidation on 30 January 2024, with £40,094 outstanding in respect of the BBL.
