Conduct: On 11 June 2020, Craig Guthrie (“Mr Guthrie”) caused Evie’s Mac & Cheese Limited (“Evie’s”) to apply for a Bounce Back Loan (“BBL”) of £50,000 for which he has failed to evidence Evie’s was eligible. Mr Guthrie has failed to evidence that funds of £49,500 from the BBL paid to his personal account were for the economic benefit of Evie’s, in breach of the BBL terms and conditions. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover; • Evie’s was incorporated on 3 January 2018; • Dormant accounts for the period end 31 January 2019, which Mr Guthrie signed, were filed at Companies House on 11 September 2019, showing £0 turnover; • Bank statement analysis for Evie’s bank account shows that between 9 October 2019 (date the account was opened) and 11 June 2020 (date of the application), Evie’s received £25,646; • On 11 June 2020, Mr Guthrie applied for a BBL of £50,000 on behalf of Evie’s declaring a turnover of £256,000; • Evie’s received the BBL funds of £50,000 on 12 June 2020; • Across 3 transactions between 12 June 2020 and 14 June 2020, Mr Guthrie made payments totalling £49,500 from Evie’s to his own personal bank account; • Mr Guthrie has failed to provide any evidence to support his assertion that turnover was £256,000 nor that the payments made to his personal account were for Evie’s economic benefit; • Total liabilities at liquidation/administration amount to £50,002 of which £50,000 relates to the amount owed in respect of the BBL.
