Conduct: Shakeb Hakime (Mr Hakime) caused Ruzfishermonger Limited (Company) to apply for and obtain £50,000 under the Government’s Bounce Back Loan scheme (BBL), when he knew or ought to have known that the Company was not entitled to that amount. In that:- • The terms of the BBL scheme allowed a company to apply for a loan up to 25% of the annual turnover of the company in the calendar year 2019 from a minimum £2,000, up to a maximum of £50,000. If a business was established after 1 January 2019, the 25% limit could be applied to the estimated annual turnover from the date the business started. • The Company applied for a BBL of £50,000, declaring an annual turnover of £250,000. The application was approved by the bank on 27/05/2020, resulting in the Company receiving a BBL of £50,000 on 28/05/2020 which it was not entitled to. • The Company’s bank account shows that in the calendar year 2019, a total of £70,073.14 was credited into the account, meaning the company was entitled to a BBL of at most £17,518. • The overstatement of turnover resulted in an overpayment of BBL totalling £32,482. • £48,478.01 of the BBL remained outstanding in the Liquidation.
