Conduct: On 12 May 2020 Scott James Whitmore (“Mr Whitmore”) caused 807 Group Ltd (“807 Group”) to breach the conditions of the Bounce Back Loan (“BBL”) facility by applying for a second BBL of £50,000 by making a false declaration when he knew or ought to have known that 807 Group was not eligible to, in that: • Under the BBL scheme businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. Businesses which originally borrowed less than the maximum amount available to them under the Scheme were eligible to top-up their original loan, however the total loan amount was not to exceed 25% of the business’s turnover. Only one loan was available to businesses.   • 807 Group was incorporated on 18 December 2017. • On 06 May 2020 Mr Whitmore made an application, to ‘Bank A’ for a BBL of £36,500 on behalf of 807 Group. On 15 May 2020 the BBL funds of £36,500 were paid into the company bank account held with ‘Bank A’. • On 12 May 2020 Mr Whitmore made a further application for a second BBL of £50,000 to ‘Bank B’ on behalf of 807 Group. On 13 May 2020 the BBL funds of £50,000 were paid into the company bank account held with ‘Bank B’. • The standard BBL application terms and conditions requires the applicant to self-declare by signing a declaration that they had not made any other application for a BBL for the business. • Mr Whitmore made a false declaration that 807 Group had not applied for another BBL, causing 807 Group to receive a second BBL which it was not entitled to. • Mr Whitmore knew or ought to have known that 807 Group was not entitled to the second BBL when the second application for the BBL was made. • 807 Group entered Creditors Voluntary Liquidation on 03 February 2025. • At liquidation, 807 Group had liabilities of £1,025,274, of which £29,786 was owed in respect of the BBL to ‘Bank A’ and £37,812 was owed in respect of the BBL to ‘Bank B’.
