Conduct: On 24 July 2020 Sunafor Ali (“Mr Ali”) caused Begum Takeaway Ltd (“Begum”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on the BBL application when he know or ought to have known that Begum was not entitled to a BBL of £50,000 based on turnover and as a result Begum received more BBL funds that it was entitled to, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the application. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. • Begum was incorporated on 12 December 2017 and accounts were filed for 31 December 2018 and as such was required to state its turnover for the calendar year 2019 in the BBL application. • On 24 July 2020 Mr Ali made a BBL application in the amount of £50,000 on behalf of Begum, declaring turnover of £230,000 for 2019 and on 03 August 2020 Mr Ali signed the BBL agreement. On 17 August 2020, Begum received the BBL funds of £50,000 into its bank account. • Accounts for Begum for the year ending 31 December 2019 show turnover of £76,699. • Based on the year ending 31 December 2019 accounts, Begum was entitled to a maximum BBL of £19,175. By making an application to borrow £50,000 Begum received £30,825 more than it was entitled to. • Begum entered into Creditors Voluntary Liquidation on 06 August 2024 with total liabilities of £67,779, of which £47,375 related to the amount owed in respect of the BBL including interest charged.
