Conduct: Mr Robert Rose, (“Mr Rose”) caused Black Hair Care Limited, (“BHC”), to obtain a £40,000 government-backed Bounce Back Loan (“BBL”), followed by a £10,000 top up BBL, which was more than it was entitled to by providing information to the lender which he knew or ought to have known was inaccurate. In that: Companies incorporated before 01 January 2019 could apply for a loan of up to 25% of turnover in the calendar year 2019, from a minimum of £2,000 up to a maximum of £50,000. If the company was incorporated after 01 January 2019, then an estimated annual turnover could be used by the applicant. BHC was incorporated on 10 November 2017 and BHC’s financial statements for the period ending 30 November 2019, (approved by Mr Rose on 28 August 2020), record annual turnover at £91,046. Bank statements for the full calendar year 2019 are not currently available, but record that from 01 March 2019 to 31 December 2019, credits totalled £66,044. On the BBL application form Mr Rose declared BHC’s turnover at £500,000 and applied for a £40,000 BBL, which was more than BHC was entitled to. The £40,000 BBL was paid into BHC’s bank account on 24 June 2020. On 15 December 2020, Mr Rose successfully applied for the further £10,000 under the Bounce Back Loan Scheme Top-Up. At liquidation on 16 November 2022, £38,026 of the BBL remained outstanding.
