Conduct: Mr Rzgar Mohammed Rostam (“Mr Rostam”) caused RMR Fleet Ltd (“RMR”) to provide inaccurate information in an application to obtain a Government-backed Bounce Back Loan (“BBL”), overstating RMR’s turnover to obtain a loan of £50,000 when he knew or ought to have known that the maximum RMR was entitled to was £10,933, In that; • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum loan of up to 25% of their turnover in the calendar year 2019 (or where businesses were established after 1 January 2019 their estimated annual turnover). The turnover figure was self-certified by the applicant. • RMR was incorporated on 6 November 2017 and commenced trading the same day. RMR was not entitled to estimate its turnover when applying for a BBL. • On 11 June 2020, Mr Rostam applied to RMR’s bank for a BBL of £50,000. Mr Rostam stated that RMR had a turnover for 2019 of £275,000. • The BBL funds were received into RMR’s bank account on 12 June 2020. • Analysis of RMR’s bank accounts show a turnover of £43,732 for the year 2019. Therefore, RMR would have been entitled to a maximum BBL of £10,933. RMR received £39,067 more than it was entitled to in BBL funds. • At the date of the liquidation there was £50,836 outstanding to the bank in respect of the BBL (including interest).
