Conduct: Asif Rashid (“Mr Rashid”) caused or allowed Salon Furniture Store Limited (“SFS”) to submit false returns of Value Added Tax (“VAT”) to HM Revenue and Customs (“HMRC”) for the VAT periods June 2022 and September 2022, resulting in SFS receiving VAT repayments totalling £198,781.38 that it was not entitled to, in that: • On 28 September 2022 a VAT return for the VAT period June 2022 was submitted on behalf of SFS resulting in a repayment of VAT to SFS of £99,321.69. Mr Rashid has failed to provide any documentary evidence to support the validity of the VAT return and HMRC has claimed a refund of the payment made. • On 11 October 2022 a VAT return for the VAT period September 2022 was submitted on behalf of SFS resulting in a repayment of VAT to SFS of £99,459.69. Mr Rashid has failed to provide any documentary evidence to support the validity of the VAT return and HMRC has claimed a refund of the payment made. Or in the alternative, that: Asif Rashid failed to ensure that SFS maintained or preserved adequate accounting records to account for the day-to-day transactions and financial position of the Company for the period 01 April 2022 to 31 December 2022, or in the alternative he failed to deliver up to the Official Receiver such records as were maintained and preserved. In the absence of accounting records for SFS the Official Receiver has been unable to: • Determine the accuracy of the VAT returns submitted by SFS for the VAT periods June 2022 and September 2022, which resulted in repayments of VAT to SFS totalling £198,781.38. • Establish the reason for payments made by SFS during the period 5 October 2022 to 1 December 2022 totalling £198,400, of which £40,300 was paid to Mr Rashid, and whether the payments were for the benefit of SFS’s creditors. • Determine the accuracy of the VAT return submitted by SFS for the December 2022 VAT period.
