Conduct: On 23 May 2020 Mindaugas Ciuras (“Mr Ciuras”) caused MDC Backup Limited (“the company”) to make a Bounce Back Loan (“BBL”) application of £50,000 using an overstated turnover figure, when he knew, or ought to have known, that the 2019 company turnover supported an application for at most £9,498. As a result, the company obtained £40,502 more than it was entitled to from the BBL scheme. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019. • The company was incorporated on 9 October 2017 and commenced trading on the same date. • On 23 May 2020 Mr Ciuras applied for a BBL of £50,000 on behalf of the company declaring turnover for the calendar year 2019 of £250,000. • The company received the BBL funds of £50,000 on 27 May 2020. • Prepared accounts for the year ended 31 October 2019, show that for the period 1 November 2018 to 31 October 2019 company turnover was £30,657. • The company operated a bank account opened on 24 January 2018, which shows company income for the period 1 January 2019 to 31 December 2019 totalling £37,993. • Total creditor liabilities at liquidation amount to £67,071 of which £49,939 relates to the amount owed in respect of the BBL.
