Conduct: On 06 June 2020 Robert Artur Strzemilowski (‘Mr Strzemilowski’) applied for and obtained a Government-backed Bounce Back Loan (‘BBL’) of £50,000 for Rob-Artex Ltd (‘RAL’) when he knew or ought to have known that RAL’s annual turnover would not have entitled it to a maximum BBL of £50,000. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), from £2,000 to a maximum of £50,000; • RAL was incorporated in September 2017 and commenced trading at that time; • As RAL was established before 01 January 2019 it was not entitled to estimate its turnover on the application form; • RAL’s bank statements record income of £40,882 in 2019, which would have entitled it to a BBL of £10,220; • On 06 June 2020 Mr Strzemilowski completed an application form for a BBL from RAL’s bank, self-certifying that its turnover in 2019 was £210,000 and requesting a BBL of £50,000; • The BBL was received on 09 June 2020; • Therefore RAL obtained £39,780 in BBL funding to which it was not entitled; • The bank submitted a claim under the Government guarantee for £44,219 and was the majority creditor in the liquidation.
