Conduct: Awes Masood (‘Mr Masood’) caused West Midlands Transportation Limited (‘West Midlands’) to obtain a Bounce Back Loan (‘BBL’) of £50,000 from Bank A using an overstated turnover figure in the loan application form which he knew, or ought to have known, was false. Consequently, West Midlands received more funds than it was entitled to, and, contrary to the terms of the scheme, Mr Masood failed to ensure that the company used all of the funds for the economic benefit of West Midlands, in that: • A business established prior to 01 January 2019 could apply for a BBL of between £2,000 and £50,000 subject to a maximum of 25% of its turnover for the calendar year 2019. • On 13 May 2020, Mr Masood caused West Midlands to make an application for a BBL of £50,000 in which the company’s turnover was stated as £220,000. • Analysis of the sales breakdown received from the accountant shows West Midlands’ turnover for the calendar year 2019 was £34,293, therefore the company was only eligible for a maximum BBL of £8,573.25 and received £41,426.75 more than it was entitled to. • Analysis of the company bank account shows that the £50,000 BBL was received on 14 May 2020. • No evidence has been provided to the Liquidators to demonstrate that £42,729 was used for the economic benefit of the company. • The BBL remained due in full when West Midlands went into liquidation.
