Conduct: On or around 30 August 2020 Mr Denis-Alexandru Clopotaritei caused Serena Care Ltd ("SCL") to apply for a Government backed Bounce Back Loan ("BBL") in the sum of £45,000 for which it was not eligible by including inaccurate information relating to trading. Thereafter, the BBL was paid into SCL's bank account on 02 September 2020. n that: • Where a business was established before 1 January 2019, it was entitled to apply for a BBL of between £2,000 and £50,000 up to a maximum of 25% of turnover for the calendar year ended 31 December 2019. • SCL was incorporated on 16 August 2017 and began trading at that time. The applicant was therefore required to declare SCL's actual turnover for the period 01 January 2019 to 31 December 2019 in the BBL application; • The BBL application submitted on behalf of SCL declared SCL's turnover for calendar year 2019 was £184,621. The application was for the BBL amount in the sum of £45,000; • SCL's accounts for the years ended 31 July 2019 and 31 July 2020 record turnover in the sums of £103,449 and £89,832 respectively. • SCL's bank statements record that it received receipts totalling £96,503 during calendar year 2019. Turnover in the sum of £96,503 would have entitled SCL to a maximum BBL in the sum of £24,126. • By over-stating the level of turnover in the BBL application, SCL received £20,874 of additional BBL funding which it was not eligible to receive. • The Bank has filed a Proof of Debt in SCL's liquidation in the sum of £44,521 in respect of the outstanding BBL.
