Conduct: On 08 June 2020 Dominic James McAuley ( “Mr McAuley”) provided false or knowingly inaccurate information concerning McCory Ltd’s ( “the Company’s”) turnover, as a result the Company obtained an additional £17,364 from the Government backed Bounce Back Loan scheme (“BBL”) to which it was not entitled. Mr McAuley further failed to provide evidence that the BBL was used in its entirety for the economic benefit of the Company contrary to the terms and conditions of the scheme. In that: • The Company was incorporated on 15 August 2017. • Bank statements for the 2019 calendar year show the Company’s income was £90,542. • The Company applied for a £40,000 BBL from Bank A on or before 8 June 2020 stating that the Company’s turnover in 2019 was £160,000 • The Company was eligible for a BBL of no more than £22,636. By applying for, and securing, a BBL of £40,000, Mr McAuley obtained £17,364 more BBL funding than he should have done. • The Company received the BBL totalling £40,000 into its bank account on 9 June 2020 • Prior to receipt of the BBL, the Company’s bank balance was overdrawn by £39, other credits paid into the account after receipt of the BBL amount to £69. • On 11 June 2020 £20,000 was transferred to a family member, which Mr McAuley attributes to the repayment of a personal loan. • Between 10 June 2020 and 28 August 2020, further payments were made for Mr McAuley’s personal benefit totalling £17,043. • Mr McAuley has failed to provide full accounting records of the Company to the Liquidator or any additional evidence to prove that the transactions listed above were for the economic benefit of the Company. • The £40,000 BBL remained outstanding at Liquidation
