Conduct: On 18 June 2020, Kevin Everton Davis (“Mr Davis”) caused Kevin Davis Construction Ltd (“the company”) to obtain a Bounce Back Loan (BBL) totalling £50,000 by overstating the company’s turnover in the application form. Consequently, the company received at least £34,605 more than it was entitled to from the BBL scheme. He also utilised at least £42,800 of the BBL funds for his own personal benefit between 18 June 2020 and 18 December 2020, contrary to the terms of the BBL scheme. In that: BBL application eligibility ? He applied online for a BBL totalling £50,000, which was credited to the Company’s bank account on 18 June 2020. This account was opened at the same time as the loan application; No other credits were received into the bank account; ? The Company operated a different bank account from 01 July 2017 until 20 August 2021 through which all trading income and expenses had been made. Bank statements show that credits were received on a near weekly basis from a recruitment agency providing labour to the construction industry. ? In the calendar year 2019 £61,581 was credited to the company’s only bank account, which would have made the company eligible for a BBL of £15,395 ? In order for the company to be eligible for a BBL of £50,000 turnover in the calendar year 2019 would have been required to be at least £200,000, based on a maximum loan to turnover value of 25%. Use of Covid support funding outside of terms of funding ? Following receipt of the BBL of £50,000, between 05 July 2020 and 31 August 2020, sums totalling £26,900 were transferred directly to him; ? Additionally between 18 June 2020 and 18 December 2020 a weekly standing order was set up to transfer £1,000 to him until all monies had been utilised; ? The only other trading income after the receipt of the BBL was £6,200 received between 18 June 2020 and 17 July 2020. In the period after 18 June 2020 he extracted at least £49,000 for personal use, of which at least £42,800 came directly from the BBL funds, which was not expended for the economic benefit of the business.
