Conduct: Andrean Vaselinov Kalev (Mr Kalev) breached the terms of the Bounce Back Loan (“BBL”) scheme by causing A&S Complete Envelopes Limited (A&S) to apply for a BBL of £40,000 on 17 December 2020 and £10,000 on 29 December 2020 when the company was not eligible to do so. Consequently, A&S received £50,000 it was not entitled to from the BBL scheme, in that: • Businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. • To be eligible the business had to be engaged in trading or commercial activity in the UK at the date of the application, had to be carrying on business on 1 March 2020 and had to have been adversely affected by coronavirus (COVID-19) • A&S was incorporated on 30 June 2017. • On 17 December 2020 Mr Kalev applied for a BBL of £40,000 on behalf of A&S declaring that its turnover was £300,000. • On 20 December 2020 the BBL of £40,000 was paid into A&S’ s Bank Account. • On 29 December 2020 Mr Kalev applied for a BBL top up of £10,000 on behalf of A&S declaring that its turnover was £300,000. • On 29 December 2020 the BBL of £10,000 was paid into A&S’ s Bank Account. • Bank records show that A&S’ s turnover for YE 31 December 2019 was £10,816. • Bank records show that A&S was not trading between 1 March 2020 and 19 December 2020 and therefore, not eligible for the BBL scheme. • On 17 January 2024 A&S was wound up in the High Court with total liabilities of £303,102 of which £50,595 relates to the outstanding BBL.
