Conduct: From 1 July 2018 to liquidation Jay Luke Franklin (“Mr Franklin”) failed to ensure that Pmad Ltd complied with its statutory obligations to make payments to HM Revenue and Customs (“HMRC”) when due and caused Pmad Ltd to trade to the detriment of HMRC in respect of Pay As Your Earn (“PAYE”), National Insurance Contributions (“NIC”) and Construction Industry Scheme (“CIS”) in that: PAYE/NIC/CIS • At the year ended 30 June 2018 Pmad Ltd owed HMRC in respect of PAYE/NIC and CIS £7,960; • In the period 01 July 2018 to 30 March 2020, Pmad Ltd incurred CIS of £60,238, PAYE/NIC of £2,200, penalties of £400 and interest of £173; • In the same period Pmad Ltd should have made monthly payments to HMRC from 22 August 2018 but only one payment on 25 March 2019 totalling £8,086 was made. Comparable Treatment • In the period from 01 July 2018 to 30 March 2020 Pmad Ltd made bank payments of £1,044,866 of which £9,845 was paid to HMRC including £8,086 in respect of PAYE/NIC and CIS • On 12 May 2020 Pmad Ltd received £50,000 in respect of a BBL; • No BBL funds were paid to HMRC; • Pmad Ltd received no further income after receipt of the BBL funds; • At the date of liquidation Pmad Ltd’s liabilities were £292,230, of which £241,382 was claimed by HMRC, £50,000 for a Bounce Back Loan (“BBL”) and £921 for utilities; • HMRC claim to cessation of trading on/around 30 March 2020 is £83,363 including £62,885 due for PAYE/NIC/CIS and £20,478 for Value Added Tax, while the balance of the HMRC claim relates to assessments raised after cessation of trading to liquidation.
