Conduct: On 12 December 2020 Mr Abdallah Bahgat (“Mr Bahgat”) breached the terms of the Bounce Back Loan Scheme by causing Fresh Flora Limited (“Fresh Flora”) to overstate its turnover on its application for a Bounce Back Loan (“BBL”) resulting in the company receiving a BBL of £50,000 when he knew or ought to have known that Fresh Flora was not eligible for a loan of this amount, in that:  • The BBL scheme rules allowed businesses to receive a loan of up to 25% of their annual turnover for the 2019 calendar year, which those businesses would self-certify when completing the BBL application. • Fresh Flora was incorporated on 27 June 2017 and commenced trading in February 2018. • The company’s Annual Accounts for financial year ending 30 June 2019 show Fresh Flora achieved a turnover of £20,148.  The accounts were signed by Mr Bahgat on 26 March 2020. • Bank statements show that between 01 January 2019 and 31 December 2019, the company received income of £20,884.52. • Mr Bahgat declared on the company’s BBL application form on 12 December 2020 an annual turnover of £250,000 and applied for a £50,000 BBL. This was paid into the company bank account on 14 December 2020. • Based on the income into the bank account for the 2019 calendar year, the company was entitled to a maximum BBL of £5,722 and therefore received £44,248 more in BBL funding than it was entitled to. • At liquidation, liabilities totalled £143,247 of which £42,951 was owed to the Bank in respect of the BBL.
