Conduct: On 31 March 2021 Miss Zoe Alexis Julia Wymark ("Miss Wymark ") caused Big Property Solutions Ltd ("BPS") to breach the terms and conditions of the Government backed Bounce Back Loan ("BBL") scheme by making an application for a BBL in the sum of £50,000 to which it was not entitled as it was not actively trading at 01 March 2020, in that: The BBL Scheme was open to most businesses, regardless of turnover, who met the eligibility criteria. Borrowers were required to declare, amongst other things, that the business was engaged in trading or commercial activity in the UK at the date of the BBL application and was carrying on business on 01 March 2020. BPS was incorporated on 23 June 2017, however, it did not commence to trade until 27 July 2020. An application for a BBL in the amount of £50,000 was made by Miss Wymark on behalf of BPS on 31 March 2021, and the funds were received into BPS’ bank account on 06 April 2021. Dormant accounts were filed with Companies House for year end 30 June 2020. The Liquidator's Report to Creditors for BPS records that BPS did not start trading until 27 July 2020 BPS's sole bank account was not opened until 09 August 2020. Miss Wymark has confirmed that BPS commenced trading on 27 July 2020. As BPS was not trading as at 01 March 2020, it was not eligible for the BBL of £50,000 it received. Repayments totalling £2,925.24 were made in respect of the BBL. BPS entered into Liquidation on 30 November 2022 with liabilities totalling £64,420, of which £48,043 was outstanding in relation to the BBL.
