Conduct: From 07 January 2018, Ms Poonsri Chana (“Ms Chana”) failed to ensure PJP789 Ltd (PJP789) complied with its statutory obligations to HM Revenue & Customs (“HMRC”) by failing to submit accurate returns for the VAT periods 11/17 and 02/18 and failing to submit returns for the VAT periods 05/18 to 10/23. VAT • PJP789 registered for VAT from 1 July 2017. • PJP789 submitted nil returns for the periods ending 11/17 and 02/18. • PJP789 failed to submit quarterly VAT returns from period ending 05/18, up until 25 October 2023 when PJP789 was placed into Creditors Voluntary Liquidation. • HMRC raised assessments for quarterly VAT periods between 05/18 to 10/23 which totalled £67,429 and a surcharge for the period 08/22 of £1,070. • PJP789 made payments towards the assessments totalling £78,741, the last payment was made on 15 November 2022. No further payments were made after this date. • On 13 March 2020, HMRC initiated a compliance check and wrote to PJP789 regarding outstanding VAT returns for the periods ending 05/18 to 11/19. PJP789 was requested to submit returns no later than 13 April 2020. Returns were not submitted and HMRC’s checks into outstanding VAT returns continued. • On 17 October 2022, HMRC informed PJP789 that the amount due for VAT periods 11/17 to 05/22 were not correct and as such an Officer’s assessment of £226,830 was raised for the VAT quarterly periods of 11/17 to 05/22. • On 28 September 2023, HMRC informed PJP789 that penalties would be charged totalling £53,114. HMRC applied no discount due to lack of engagement from PJP789. • HMRC applied interest totalling £45,996. • At liquidation PJP789 had creditors totalling £385,468, of which £315,698 was due to HMRC in respect of VAT.
