Conduct: Kazimierz Prusinski (“Mr Prusinski”) caused Kaz Services Limited (“Kaz”) to breach the terms and conditions of the Government backed Bounce Back Loan ("BBL") scheme by knowingly or he ought to have known that the turnover in the BBL application to obtain a BBL of £50,000 was overstated. This resulted in the Company receiving at least £40,375 more than it was entitled to. In that: • The BBL application scheme entitled businesses established prior to 01 January 2019 to apply for a BBL in the sum of up to 25% of its turnover in the calendar year 2019. • Kaz was incorporated on 04 May 2017, and it commenced trading around May 2017. • On 03 October 2020 Mr Prusinski, on behalf of Kaz, applied for a BBL. On the application form Mr Prusinski stated that Kaz had a turnover of £204,000. • On 14 October 2020, a BBL of £50,000 was paid to Kaz. • Kaz’s Company Tax Return for 2020 shows turnover of £28,583 and £30,621 for the years ended 31 May 2019 and 31 May 2020. • Analysis of Kaz’s bank statements shows that in the 2019 calendar year the Company received total credits of £38,498.50. • Based on the income shown in the bank account, the maximum BBL Kaz would have been eligible for a BBL of £9,625. • Kaz was not eligible for a BBL of £50,000, it obtained at least £40,375 more in BBL funding than it was entitled to. • The BBL lender is owed £49,945.59 in respect of the BBL.
