Conduct: On 06 May 2020, Mr Ataur Rahman ("Mr Rahman") caused Spice Fusion Stoke Limited ("Spice Fusion") to apply for a Government backed Bounce Back Loan ("BBL") in the sum of £49,000, for which it was not eligible by including inaccurate information relating to turnover. Thereafter, the BBL was paid into Spice Fusion's bank account on 07 May 2020. In that: • Where a business was established before 01 January 2019, it was entitled to apply for a BBL of between £2,000 and £50,000 up to a maximum of 25% of turnover for the calendar year ended 31 December 2019. • Spice Fusion was incorporated on 21 April 2017 and began trading shortly afterwards. The applicant was therefore required to declare Spice Fusion's actual turnover for the period 01 January 2019 to 31 December 2019 in the BBL application. • The BBL application submitted on behalf of Spice Fusion by Mr Rahman declared that its turnover for 2019 was £198,000 and applied for a BBL in the sum of £49,000. • Financial statements for Spice Fusion record that its turnover for years ended 31 March 2019 and 31 March 2020 record turnover in the sum of £76,087 and £78,474 respectively. • Mr Rahman provided evidence to support that Spice Fusion’s turnover for calendar year 2019 was £142,653. • By over-stating turnover in its application, Mr Rahman caused Spice Fusion to obtain £13,511 more in BBL funds than it was entitled to receive. • The Bank has confirmed that the sum of £35,488.74 remained outstanding in respect of the BBL.
