Conduct: On 13 October 2020, Mohammed Akrom (“Mr Akrom”) applied for a Government Bounce Back (“BBL”) when he knew, or ought to have known, that E3 Grill Ltd (“E3”)’s turnover was insufficient for a BBL of £50,000. Furthermore, the BBL funds were not used for the benefit of E3 in that: • E3 was incorporated on 06 April 2017. • Mr Akrom was appointed as the sole director from incorporation until liquidation. • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. Where a company commenced trading after 01 January 2019, the applicant was entitled to provide a reasonable estimate of Company annual turnover from the date it started business. • E3 commenced trading in 2018 and therefore was not entitled to estimate its turnover. • Accounts for the year ending 30 April 2019 record turnover of £68,881, approved by Mr Akrom on 21 January 2020. • Accounts for the year ending 30 April 2020 record turnover of £77,235, approved by Mr Akrom on 14 April 2021. • E3 was eligible for a maximum BBL of £19,309. • On 13 October 2020, Mr Akrom applied to HSBC for a BBL in the sum of £50,000 having stated that E3’s turnover was £200,000. • On 22 October 2020 £50,000 was paid into E3’s bank account resulting in E3 receiving £30,691 more than it was entitled to. • On 02 October 2020 Mr Akrom incorporated another company registered at the trading address of E3 whose business was Unlicenced Restaurants and Cafes. • A review of E3’s bank statements show that trade credits into the account cease from 09 December 2020.
