Conduct: On 12 August 2020, Abdul Hoque (“Mr Hoque”) caused E2 Grill Ltd (“E2”) to apply for a Government backed Bounce Back Loan (“BBL”) of £50,000 when he knew or ought to have known that E2 would have been eligible for no more than £16,583 BBL funding. In that: • E2 was incorporated on 27 March 2017. • Mr Hoque was appointed as the sole director from incorporation until 01 June 2021 • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. • Accounts for the year ending 31 March 2019 record turnover of £66,330 and for the year ending 31 March 2020 record turnover of £62,713. • Based on its turnover for the year ending 31 March 2019, E2 was eligible for a maximum BBL of £16,583. • On 12 August 2020, Mr Hoque applied to E2’s bank for a BBL in the sum of £50,000 stating turnover of £210,000. • On 13 August 2020, E2 received the £50,000 BBL into its bank account which was £33,417 more than it was entitled to. • As at liquidation at least £50,000 was due in respect of the BBL, no repayments had been made by E2.
