Conduct: Selim Ibishi (“Mr Ibishi”) failed to ensure that between 19 September 2018 and 06 March 2020 (date of liquidation) Calabreze Restaurant Ltd (“Calabreze”) maintained or preserved adequate accounting records or he failed to deliver up such accounting records as were maintained or preserved to the Liquidator. As a consequence of this failure it has not been possible to: • Determine the expenditure of the company for the period from 19 September 2018 to the date of liquidation or to determine whether all expenditure on the bank account used by Calabreze, totalling £337,270 was for the benefit of Calabreze, in particular a) cash withdrawals from 25 September 2018 to 17 December 2019 of £39,550 b) monies payable to a former employee of Calabreze from 12 November 2019 to 27 December 2019 of £39,017 c) monies payable to an associated company from 22 September 2018 to 18 February 2019 of £36,250 d) monies payable to him of £15,000 being £5,000 on 6,7 and 8 November 2019 e) monies paid to a relative of his from 19 March 2018 to 17 December 2019 of £17,671. • Determine the income of the company for the period from 19 September 2018 to the date of liquidation or to determine whether all receipts into the bank account used by Calabreze, totalling £209,384, were derived from trading. • Determine the accuracy of the HMRC claim in the insolvency for VAT of at least £90,552 which was all based on assessments.
