Conduct: James Peter Tanswell (“Mr Tanswell”) caused Taltech Limited (“TL”) to breach the conditions of the Bounce Back Loan Scheme by overstating TL’s turnover and obtaining a larger loan of £50,000, when he knew or ought to have known that TL was not eligible for a loan of this amount based on filed accounts and bank analysis as listed below: - • Under the Bounce Back Loan (“BBL”) scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure required was that for the calendar year 2019 or where a business was established after 1 January 2019 it is their estimated turnover. To be eligible, businesses were required to be engaged in trading or commercial activity in the UK at the date of the application, carrying on business on 1 March 2020 and be adversely impacted by coronavirus; • Filed accounts to the end of March 2019 show a turnover of £105,315 and filed accounts to the end of March 2020 show a turnover of £105,386 which gives an estimated turnover for the calendar year 2019 of £105,368.25; • Bank analysis shows that TL received credits totalling 133,921.83 from the period 29 April 2019 to 29 April 2020; • Mr Tanswell applied for a BBL of £50,000 on behalf of TL on or around 13 May 2020 declaring in the BBL application that TL’s turnover for 2019 was £200,000; • On 13 May 2020 a BBL of £50,000 was credited to TL’s bank account; • Based on filed accounts covering the calendar year 2019 and bank analysis abovementioned, TL received more BBL funds than entitled to • Total liabilities at liquidation amount to £115,384 which includes debts of £50,633 in respect of the BBL and £64,751 to HM Revenue & Customs.
