Conduct: Mr Damian Wojcikowski (“Mr Wojcikowski”) caused Platinum Trans Ltd (“PT”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by declaring a turnover figure in the BBL application that he knew or ought to have known was overstated and PT obtained the maximum BBL amount of £50,000. This resulted in the Company receiving at least £39,992.20 more than it was entitled to. In that: • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. Where a company commenced trading after 01 January 2019, the applicant was entitled to provide a reasonable estimate of Company annual turnover from the date it started business. • PT was incorporated on 23 February 2017 and commenced trading around 27 February 2017. Mr Wojcikowski was appointed as director on 23 February 2017 and was sole director until the PT’s Liquidation on 07 December 2023. • On 14 September 2020 Mr Wojcikowski applied for a £50,000 BBL from a BBL lender. On the application, Mr Wojcikowski declared that PT’s 2019 calendar year turnover was £208,000. • On 06 January 2021, PT received a BBL of £50,000. • As the Company was established prior to 01 January 2019 the Company’s actual 2019 calendar year turnover should have been declared on the BBL application. • Analysis of the Company’s bank statements show that in the calendar year 2019 the company received £40,031.20 in credits. • Based on income into the Company bank account for the calendar year 2019 (£40,031.20), the maximum BBL that the Company would have been eligible for would have been £10,007.80. Mr Wojcikowski therefore obtained an additional £39,992.20 in BBL funding to which PT was not entitled. • The BBL remains outstanding. The BBL lender is a creditor in the Company’s liquidation in the sum of £46,227.96.
