Conduct: Syed Mahmood Ahmad (“Mr Ahmad”) caused Heavens Above International Limited (“Heavens”) to breach the terms & conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 to which it was not entitled. Consequently, Heavens received monies that it was not entitled to from the BBL scheme, in that: • The Bounce Back Loan (“BBL”) criteria allowed a company to borrow between £2,000 and a maximum of £50,000 based on 25% of the company’s turnover for the 2019 calendar year. • The eligibility criteria required a business to be established and actively trading at 01 March 2020. • Heavens was incorporated on 06 February 2017. • Heavens submitted dormant accounts for the years ending 28 February 2018, 28 February 2019, 28 February 2020 and 28 February 2021. • Mr Ahmad applied for a BBL on behalf of Heavens, stating on the application form a turnover of £215,000 and the BBL funds of £50,000 were paid into the company bank account on 17 February 2021 • There is no evidence that Heavens was actively trading at 01 March 2020. As such Heavens was not eligible for a BBL of any amount. • At liquidation the sum of £46,693.96 remained outstanding in respect of the BBL.
