Conduct: Calum Manus Camara-Hill (“Mr Camara-Hill”) caused E5 Carpentry Ltd (“E5”) to apply for a Coronavirus Business Interruption Loan (“CBIL”) of £100,000 and failed to use this to repay the existing Bounce Back Loan (“BBL”) in full as per the terms and conditions of the loan. In that: • E5 was incorporated on 31 January 2017. • E5 applied for and obtained a BBL of £50,000 on 05 May 2020. • E5 applied for and obtained a CBIL of £100,000 on 08 February 2021. • The CBIL application form was submitted by James Francis Fitzpatrick Hurley on 04 February 2021. • The CBIL Key Contract Terms stated that the CBIL needed to be used to repay the whole of any existing BBL. However, the CBIL was not used to repay the BBL. • Despite having access to information provided by the loan provider, Mr Camara-Hill has explained that the CBIL was not used to settle the existing loan under the BBL scheme as he was not aware that this needed to be done. • At the date of liquidation, the outstanding CBIL was £89,606.04.
