Conduct: Mashud Choudhury (“Mr Choudhury”) breached his duties as a director of Spice Key Limited (“Spice”) by failing to ensure that it complied with legislative requirements in that: Spice did not comply with its statutory obligations under The Immigration, Asylum and Nationality Act 2006 resulting in the employment of 3 illegal workers. Home Office Immigration Enforcement (“HOIE”) after investigating Spice Merchant issued a Notification of Liability for a Civil Penalty of £10,000 in respect of the employment of 1 illegal worker, payment of which was due on or before 24 September 2018. Spice paid £2,296 against the civil penalty due to HOIE with £7,704 still remaining outstanding at liquidation. Following a further visit to Spice’s trading premises on 30 October 2019, HOIE officers identified a further breach. After investigating HOIE issued a further Notification of Liability for a Civil Penalty of £30,000 in respect of the employment of 2 illegal workers, payment of which was due on or before 20 December 2019. Spice did not pay the fine of £30,000 due to HOIE. Mr Choudhury was an appointed director of the company at the time of the breach of the Immigration, Asylum and Nationality legislation.
