Conduct: On 15 May 2020, Brenton Roy Dwyer (“Mr Dwyer”) allowed A&D Carribbean Takeaway Ltd (“A&D” or “the Company”) to make a declaration which he knew, or ought to have known, was false when applying for a Bounce Back Loan (“BBL”) of £50,000 to which the Company was not entitled, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of 25% of turnover. The turnover figure was self-certified by the applicant. • Mr Dwyer was an appointed director of the Company at the time when his co-director applied for a BBL of £50,000 on 15 May 2020 on behalf of the Company, stating a turnover of £210,478. • As A&D was incorporated 20 January 2017, was carrying on its business on 01 March 2020. and engaged in trading or commercial activity in the United Kingdom as at the date of the application, the Company was required to apply using the generated turnover for calendar year 2019. Fiscal year turnover per year end 31 January 2020 accounts was £60,414. This would entitle company to a BBL of £15,000 meaning the company obtained £35,000 it was not entitled to under the scheme. • The company’s bank statements show repayments totalling £10,692 have been made, representing actual financial loss of £24,308. • On 14 May 2023, A&D entered Liquidation with total liabilities of £73,690 of which £42,084 was in respect of the BBL.
