Conduct: Mr Antony James Ross (“Mr Ross”) caused Workers Room Ltd (“WR”) to breach the terms and conditions of the Bounce Back Loan (BBL) scheme by overstating the company’s turnover in order to obtain a government-backed bounce back loan (“BBL”) to which it was not fully entitled and failed to use it for the economic benefit of WR, in that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it is their estimated annual turnover from the date that the business was started. • WR was incorporated on 17 January 2017, Mr Ross was appointed as director on incorporation and remained the sole director until WR entered into liquidation on 07 September 2022. • Dormant accounts were filed for the year ended 31 January 2018. • Micro-entity accounts approved by Mr Ross on 31 May 2020, for the year ended 31 January 2020 show WR’s turnover was £128,600 for the period 31 January 2019 to 31 January 2020. • On 07 August 2020 Mr Ross applied for a BBL on behalf of WR for the maximum amount allowable of £50,000 declaring the company turnover for 2019 was £210,000. • The BBL funds were credited to WR’s bank account on 19 August 2020. • On 20 August 2020 £50,000 was transferred to Mr Ross’ personal bank account. • Mr Ross has not provided evidence to show that the funds were used for the economic benefit of the company. • The BBL remains outstanding and the loan provider is a creditor in the liquidation for a total of £51,264.43.
