Conduct: On 7 December 2020 Kate Sutherland (“Miss Sutherland”) caused K&J Consult Ltd (“K&J”) to provide misleading information to a bank to obtain a Bounce Back Loan (BBL) of £50,000 when she knew or ought to have known that K&J was not eligible for a loan and failed to ensure that the BBL was used for the economic benefit of K&J, in that: a. The terms of the BBL scheme allowed a company to apply for a loan up to 25% of the annual turnover of the company from £2,000, up to a maximum of £50,000. If a business commenced trading after 1 January 2019, the estimated annual turnover could be used. b. On the BBL application dated 7 December 2020 Miss Sutherland stated K&J’s turnover was £200,000 and confirmed that the amount of BBL applied for was equal to or less than 25% of annual turnover for 2019, or of the estimated annual turnover. c. K&J declared net turnover totalling £3,520 in the quarterly VAT returns submitted to HMRC for the periods between 1 January 2019 and 31 December 2019.The turnover was below the turnover level of £8,000 that was required to obtain the minimum BBL of £2,000 and so K&J was not eligible for a loan under the BBL scheme. d. On 9 December 2020 the £50,000 BBL was credited to K&J’s bank account. e. On 11 December 2020 two payments of £40,000 and £10,000 were made from K&J’s bank account that were not for the economic benefit of the company. f. K&J’s bankers are creditors in the company’s liquidation for £50,000 in respect of the BBL
