Conduct: Michael Andrew Shuttleworth (“Mr Shuttleworth”) caused Stove Service (Northallerton) Limited (“The Company”) to make an application for a Bounce Back loan (BBL) of £50,000 quoting a turnover which he knew or ought to have known was inaccurate and subsequently failed to use the entirety of the BBL for the economic benefit of the company. In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019, or where a business was established after 01 January 2019 it was their estimated turnover. The BBL was to be used to provide economic benefit to the company, wholly for business purposes and not personal purposes. • The company was incorporated on 05 December 2016 with Mr Shuttleworth as the sole director. • On 5 May 2020 Mr Shuttleworth on behalf of the company submitted a BBL application declaring that its annual turnover was £126,000 and stating that the company would like to borrow £30,000. On 6 May 2026 Mr Shuttleworth advised the BBL provider that the company’s turnover was £214,000 and on that basis he requested the BBL amount was increased to £50,000. • The financial statements for the accounting period ending 31 December 2019 state a turnover of £62,576 entitling the company to a BBL of £15,500. • On 07 May 2020, the company received £50,000 in BBL funds. • Between 19 May 2020 and 10 July 2020 payments totalling £12,000 were made directly to Mr Shuttleworth, which were not for the economic benefit of the company. • At Liquidation, the BBL had an outstanding balance of £50,367.32
